Slip and Fall Accidents

A "slip and fall" or "trip and fall" injury occurs when someone slips, trips or falls as a result of a dangerous or hazardous condition on someone else's property.  Such accidents can arise in a variety of situations.  The cause of a slip and fall injury could be a gap or a hard to see hole in the ground, a slippery floor due to water, ice or snow, or even abrupt changes in flooring, such as poor lighting and so on. The National Center for Injury Prevention and Control estimates that in 2004, more than 8 million people were injured in such accidents.

When a person slips and falls, their case usually comes under the category of premises liability.  Premises liability means that if you are on someone else's property and injure yourself as a result of a dangerous condition on the property, the landowner or business proprietor may be liable for your injuries and you may be legally entitled to financial compensation.

Hazardous conditions in which slip and fall accidents may occur include:

  • Broken stairs
  • Cracked or uneven pavement
  • Exposed holes
  • Failure to post proper warning signs
  • Falling objects
  • Poor lighting
  • Slippery conditions
  • Tripping hazards

Depending on the facts of your particular cases, generally the following damages are recoverable:

  • Compensation for pain and suffering as a result of the incident
  • Lost income for time from work
  • Medical bills and expenses incurred as a result of the incident
  • Recovery of the fair value of clothing damaged in the incident

Slip and fall related injuries are of large concern.  According to the Center for Disease Control, in 2005, 15,800 people age 65 and older died from fall-related injuries, 1.8 million age 65 and older were treated in emergency rooms for fall-related injuries, and over 433,000 of these people were hospitalized.
